Here in NJ, as long as the family moves their residence, no one can bar athletic participation. It happens all of the time. About 5 years ago there 2 wrestling brothers that as juniors won district and sectional titles. As seniors they returned to the mat but never got along with the coach. In january, Middle of the wrestling season and after both had won county titles, they up and moved out of the house with their mother into a house in a neighboring town with their father.
It just happened that the school where the father lived had but 2 weak weight classes - the 2 the boys won titles at. The state rules made them practice for 7 days before they could be on the varsity. After they did the team went on to win the state championship.
Even if you don't move, the state makes sit a max of 30 days from the onset of the season.
